Yes, I imagine this does raise a thorny set of legal issues. I, too, am not a lawyer. Just a long time ago... in a galaxy far far away... I took a couple constitutional law classes in college, and that is about it. I could certainly imagine a savvy defense lawyer making good use of the First Amendment to shield from holding to account some pundit on Fox News, or some podcaster, or even an ex-President for their role in incitement of violence. I'm not equipped to argue the legal case.

But I could certainly make a philosophical argument, namely that every "right" also carries a "responsibility." Pity so many people who drape themselves in the First Amendment--or the Second Amendment, for that matter-- seem oblivious to that fact.

Anyway, you do raise an interesting topic, what if any mechanism there may be to take legal action against stochastic terrorists. It appears our laws and justice system are not equipped to deal with it at all.
