The point you make is proof of my point, the fact that it was a unanimous (dodge-the-issue) decision. I did not dwell on it expressly in what I wrote, but my criticism is for 9 justices. They all dodged the issue... because none of them dared take on Trump head-on. Because they all factored in extraneous issues outside of the law (which is precisely what they are not supposed to do, and is something both liberals and conservatives on the court do too often--and is the reason why this court is held in record low esteem by the American public).
I will leave it to the three liberals to someday explain (if ever) what back room deals and negotiations twisted their arms to fall in line and not rock the boat. But all nine justices got this wrong.
I stand with Judge Luttig on this one. And he is as far removed from The Left as one can possibly be. He says they got it wrong, and he is a knowledgeable constitutional scholar who convinced me through his explanation of the proper legal reasoning to apply to this issue.
But your final point is quite right. We The People can enforce section 3 of the 14th Amendment (since no one else is going to) by voting against insurrectionists.
